Responding to the demands of the football world and the sports law community, the fourth edition of EPFL Sports Law Bulletin presents an impressive collection of legal notes and opinion articles related to the principle of contractual stability and the most resounding disputes between clubs and players.
The lawyer Juan de Dios Crespo writes about “Matuzalem, reinforcing the maintenance of contractual stability: article 17 and its future” and Mario Gallavotti about “From Webster to Matuzalem – Kickoff or final whistle?”. “The CAS decision on Matuzalem” is the title of the article signed by Mark Boetekees. “Webster and Matuzalem: how should leagues and clubs move forward in light of this “conflicting” jurisprudence?” by Carol Couse and “The compensation for the breach of sports contract in the Portuguese Law – an unwise, unreasoning, unbalanced and unconstitutional solution” by Albino Mendes Baptista are also some of the significant legal analysis that readers can find in the fourth edition of the EPFL Sports Law Bulletin, which also comprises an exclusive piece on the “Amendment to the Regulations on the Status and Transfer of Players relating to the protection of minors”, with the signature of Marco Villiger, the FIFA Director Legal.
Besides contractual stability issues, this edition covers other important themes, such as the new FIFA Transfer Matching System. Important explanations on the contours and far-reaching impact of this innovative system are provided by the FIFA TMS General Manager Mark Goddard.
As in past editions, a wide range of information on the latest sport regulations are provided in this number side-by-side with an updated summary of jurisprudential decisions related to players’ transfers, players’ injury or online sports betting. The UEFA campaign against racism and the creation of the UEFA club financial control panel, within the scope of its own club licensing system, are some of the other matters covered therein.
Not less importantly, the EPFL Sports Law Bulletin raises the tip of the veil on the International Conference that the EPFL shall organize on “Contractual Stability and Dispute Mediation and Arbitration Systems” and publishes the entire programme and list of keynote speakers. The event will take place on the 29 October 2009, in Sala Cinquecento at the historical Pallazzo Vecchio, in Florence, Italy.
